Light Rail In Phoenix – The antidote for DUI?

Proponents of the Phoenix light rail system that is deep into construction claim that the project will reduct DUI cases by offering people an alternative mode of transportation to and from downtown for cultural and sporting events. I’m not so certain.

In Phoenix, I would estimate that at least half of the DUI cases that come through my office resulted from an officer pulling over a vehicle shortly after it left a non-downtown bar.

While the light rail project may result in a redistribution of Phoenix Police Officers from the light rail area to other areas, my prediction is that they increase enforcement around the bars with the extra manpower (if the budget cuts don’t get the manpower first).

The other argument against light rail as the cure to DUI is that alternative modes of transportation already exist and have for years. Cabs. Buses. Designated drivers. They are all available in the Phoenix area (although buses with some effort). DUI is often about a bad last minute choice. The 2 am judgment call. Will the availability of light raid alter the way people think? I doubt it.

Arizona Extreme DUI – Prepare for 30 days in jail for a first offense

It’s official. The new Arizona DUI law signed by the governor last week will make a first offense extreme DUI conviction carry a mandatory minimum 30 days in jail. Currently, it carried 10 days in jail (30 days with 20 days suspended). After this new law takes effect a Judge will not have any authority to suspend any of the 30 days.

What makes this particularly harsh is that the average first offense DUI that we see in our law firm is probably around a .150, which is the extreme DUI limit.

So now, ordinary citizens, with no criminal history whatsoever, will face the prospect of either submitting to 30 days in jail or fighting to have the charge reduced or dismissed. In places like Tucson and Phoenix, 30 days in jail is no cake walk. The Tucson jail is probably better than the Maricopa County jail, but it would be difficult to argue that either is a plesant place to spend a month of one’s life.

Phoenix DUI Shaming Website – Track AZ DUI Penalties

The Maricopa County Attorney’s website stopduiaz .com has some interesting and valuable information for those arrested for DUI in Scottsdale, Peoria, Gilbert, Glendale and Tempe. It shows each person who has pled guilty or who has been found guilty, along with their name, picture and the sentence they received.  These are for misdemeanors.

The website also features selected vehicular felonies and their prison sentences.

What the website does not tell us is if, or how much jail time, was suspended for each sentence listed.
