In Florida, it is common for people charged with DUI while they have a child in the car to also be charged with child neglect.

Hudson mother charged with DUI, neglect – St. Petersburg Times: “A Hudson woman was arrested Friday after causing a vehicle crash while driving under the influence with her 8-month-old child in the car, according to the Florida Highway Patrol.

Julie Gray, 24, was involved in a three-car crash around 4:30 p.m. at U.S. 19 and Embassy Boulevard near Gulf View Square mall. Gray was foaming at the mouth, mumbling, swaying and unable to listen, according to the patrol report. She is charged with driving under the influence of a controlled substance and child neglect. The infant appeared to be uninjured but another driver was hurt, the report said. Gray was released from the Land O’Lakes jail early Saturday.”

Each state treats DUI with a child in the car differently. In some states it is an additional charge. In other states it is a factor that can aggravate a sentence. Under Arizona DUI law, for example, it becomes a class 6 felony.
