It will be interesting to see what the state uses to support an allegation of 1st degree murder. I assume this was a mistake in the article, but if it is not, it just goes to show that it is never worth it to ever get behind the wheel of a vehicle in Arizona after having anything to drink because it exposes you to anything from a basic misdemeanor DUI to 1st degree murder.

The suspect, Enrique Acosta Jr., 27, of Phoenix, was booked into a Maricopa County jail on two counts of first-degree murder, two counts of endangerment and two counts of aggravated assault, he added.
Bail for Acosta, an ex-convict who has served time for drunken driving, has been set at $2 million.
